High Court upholds decision on Nimishamba Temple
Bangalore, July 25, 2013: The High Court on Wednesday upheld a single judge’s order that approved the government’s move to transfer Nimishamba Temple near Srirangapatna to the Muzrai Department.
A division bench comprising Justices K L Manjunath and Ravi Malimutt directed the government to consider the plea of the former trustees of the temple to include them in the committee to be formed to administer the temple.
However, this will only apply if the representation given by them is not in violation of any rules, it said. The bench also directed the petitioners to file a suit under Section 21 of the Karnataka Hindu Religious and Charitable Endowment Act if they want to pursue the matter.
The government transferred the temple to the Muzrai Department through a notification on April 30, 2003 as per Karnataka Hindu Religious and Charitable Endowment Act. The temple trustees challenged the government’s move in the court earlier.
A single judge dismissed their petition.
